Beginning of the Historic Hearing in India

A bench of five senior most Judges in the country from different religious backgrounds will be looking into the validity of Triple Talaq

The Triple Talaq case which originated from the petition filed by Shayara Bano has finally resulted in the beginning of the hearing regarding the enforceability of the same. The Supreme Court has brought in a bench of five judges who will be hearing the petition that challenges the alidity of Triple Talaq. Senior most judges of the country, Chief Justice JS Khehar, Justice Kurian Joseph, Justice Rohinton Nariman, Justice Uday Lalit and Justice Abdul Nazeer belonging to the Sikh, Christian, Parsi, Hindu and Muslim community respectively are on the bench. The absence of even a woman on the bench was noted by few.

Banned in even Muslim majority countries like Pakistan and Bangladesh, the practise however continues in India to date. The Supreme Court will now decide on the validity of Triple Talaq and examine if it is fundamental to the practise of the religion. “Each side can argue whatever they want but there should not be any repetition. They will only focus on the validity of triple talaq”; the bench said.

The case hearings are planned to be completed by May 19. The judgment however, can only be expected some time in June. It will be a historic moment in law and politics for the country, whatever the judgement may be.
